These terms and conditions govern all contracts entered into by the company for
the supply of sale of goods or services. Any order given to the company shall
be deemed to constitute an Agreement to be bound by these terms and conditions.
No variations of these terms and conditions shall be of any effect unless agreed
by the company in writing.
Description of goods
The company brochure
and any elevated drawings serve as a guide only and do not form part of any
contract. The company reserves the right to alter specifications without prior
notice. Some timber sizes are nominal and subject to normal variations. Timber
is a natural product which is inspected at the time of manufacture, we cannot be
held responsible for any timber shrinkage, warping, cracking or movement after
erection. In the event of any error the company requires full written
correspondence.
Prices
All prices are
subject to vat at the current rate. Once your deposit is received the price
will stay fixed for three months.
Payment
All goods remain the
property of the company until paid for in full. A 50% deposit is required upon
placement or order, the balance of payment is due strictly on the day of
installation. Any outstanding balances will automatically be deducted from
debit or credit cards on the day of delivery. If payment is made by cheque this
must be handed to the delivery driver on day of receipt.
If the customer
wishes to cancel the order 14 days prior notice is required, whereupon the
deposit will be returned in full. The company reserves the right to dismantle
and remove any buildings not paid for in full. The customer must allow full
access to the site for this purpose and will be notified in writing of this
intent. Interest will be charged at a rate of 5% on overdue payments.
Delivery
Any time or date
given by the company for delivery is intended as an estimate only and the
company shall not be liable in any manner whatsoever for any loss or damage or
failure to deliver within such times. No delay or failure in respect of
delivery or part delivery shall entitle the customer to treat the contract as
repudiated. Electricity is required to enable us to bolt down on site. The
company will not deliver buildings or machinery through domestic buildings or
over fences.
Bases & Installations
All bases must be
level with correct drainage in place. The company reserves the right to refuse
to erect the buildings if the base does not meet the required standard and will
charge an additional delivery fee to return at a later date.
Guarantee
We guarantee both the galvanised steel runs and the tanalised timber, used in the manufacture of our kennels and runs, for 12 years against rot and corrosion.
Law Governing This
Contract
The contract shall in
all respects be construed and operated as an English contract governed by
English Law and any dispute arising out of, or in connection herewith, shall be
referred to the English courts.
